Terms of Service

Introduction

These Terms of Service ("Terms") govern your access to and use of the mobile application Flokk, our website, and related services (collectively, the "Services"), provided by Flokk IT AS, a limited company incorporated under Norwegian law, org. no. 936482546. ("Flokk", "we", "us", "our"). By downloading, installing, or using the Services, you agree to these Terms and our Privacy Policy.

Definitions

  • "User" means any individual who registers for, accesses, or uses the Services.
  • "Account" means the user account you create to use parts of the Services.
  • "User-Generated Content" means data, photos, comments, ride records or other content you upload, create, or share via the Services.
  • "Paid Services" means any subscription, premium feature or in-app purchase that requires payment.

Eligibility and account registration

  • You must be at least 13 years old to use the Services. If local law requires a higher minimum age, you must meet that.
  • If you are under 18 years old, you must have consent from a parent or legal guardian.
  • You agree to provide true, accurate, current and complete information when you register, and to keep that information updated.
  • You are responsible for safeguarding your login credentials and for all activities that occur via your Account.

License and access

  • Subject to your compliance with these Terms, Flokk grants you a limited, non-exclusive, non-transferable license to use the Services on devices that you own or control.
  • You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Services unless expressly permitted by Flokk.

Use of the Services

You agree you will use the Services in compliance with all applicable laws and these Terms. In particular, you will not:

  • upload or share content that is illegal, hateful, harassing, defamatory, discriminatory, pornographic, or violent;
  • impersonate others, misrepresent your affiliation with a person, community or organization;
  • collect or store personal information about others without their consent;
  • transmit viruses, malware, or other harmful computer code;
  • interfere with, disrupt, or damage the operation of the Services;
  • reverse engineer or attempt to decompile the app, except to the extent permitted by mandatory law.

User-Generated Content

  • You retain ownership of User-Generated Content you submit.
  • By uploading or submitting content, you grant Flokk a worldwide, royalty-free, non-exclusive, transferable license to use, reproduce, distribute, adapt, modify, publish, and display your content for the purposes of operating, promoting, and improving the Services.
  • Flokk may review, remove or disable content that violates these Terms or applicable law, without liability.

Location, device permissions and data

  • The app may request access to features on your device (e.g. location/GPS, camera, notifications). You consent to such access for the purpose of providing the Services. You may withdraw these permissions via your device settings, but that may limit functionality.
  • We collect and process personal data in accordance with applicable data protection legislation.
  • We only collect what is necessary: e.g. name, email, contact info, location data (where needed), usage data.
  • You have rights under GDPR: access, correction, deletion ("right to be forgotten"), restriction, data portability. You can withdraw consent at any time where processing is based on consent.
  • Where we rely on your consent to process your personal data (for example, for marketing communications, analytics, or location tracking), you will be asked to provide separate consent for each purpose. You may withdraw or modify your consent at any time via the app's privacy settings or by contacting us. Withdrawing consent will not affect the lawfulness of processing based on consent before its withdrawal.
  • We process certain personal data as necessary to provide the Services (e.g. account management), some data under our legitimate interests (e.g. service improvement), and some only with your explicit consent (e.g. marketing, location tracking). For details, please refer to our Privacy Policy.
  • If you are under the age of digital consent as defined by Norwegian law, parental consent is required for processing your personal data.
  • We do not sell or share your personal data with third parties for unrelated purposes. Where data is shared with service providers (e.g. cloud hosting, analytics), this is disclosed in our Privacy Policy and subject to appropriate safeguards.

Modifications

  • Flokk may update the Services (bug fixes, new features, etc.).
  • Flokk may also change these Terms. If changes are material, we will notify you (e.g. via email or in-app). Continued use after notice means you accept the changes.

Disclaimers and warranties

  • The Services are provided "as is" and "as available." Flokk does not warrant that the Services will be uninterrupted, secure, or error-free.
  • To the extent permitted by law, Flokk disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, non-infringement.

Limitation of liability

  • To the maximum extent permitted under Norwegian law, Flokk shall not be liable for any indirect, incidental, consequential, special, or punitive damages, loss of profits, loss of data or use, arising out of or in connection with your use of the Services.
  • Flokk is not liable for any incidents that occur during events listed on the platform.

Indemnification

You agree to indemnify and hold Flokk, its affiliates, officers, employees, agents and licensors harmless from any claim, loss, liability, cost, damage, or expense (including reasonable legal fees) arising out of or in connection with:

  • Your breach of these Terms;
  • Your misuse of the Services;
  • Your User-Generated Content;
  • Your violation of law or rights of another.

Termination

  • Either you or Flokk may terminate your Account at any time. You may do so through the app or by contacting support.
  • Flokk may suspend or terminate your access immediately if you violate these Terms, or for security, legal, or business reasons.
  • Upon termination, the rights and licenses granted to you will cease. Certain provisions (e.g. Intellectual Property, Limitation of Liability, Indemnification) survive termination.

Intellectual property

All intellectual property rights in the Services (including software, trademarks, logos, designs, graphics, content, domain names) are owned by Flokk or its licensors. These rights are protected under the Norwegian Copyright Act and other applicable laws.

Governing law and dispute resolution

  • These Terms are governed by the laws of Norway.
  • Any dispute arising in connection with these Terms that cannot be resolved amicably will be brought before the ordinary courts. The agreed venue for any legal proceedings is Oslo District Court (Oslo Tingrett), unless mandatory law requires otherwise.

Child safety (CSAE compliance)

We have zero tolerance for child sexual abuse and exploitation ("CSAE"). You may not create, upload, share, request, distribute, promote, or glorify any content that exploits or endangers children, including grooming, sexualization of minors, sextortion, trafficking, or child sexual abuse material ("CSAM"). Any such content or behavior will result in immediate removal and account termination.

If we become aware of CSAE or CSAM, we will remove it without notice and, where required by law, report confirmed instances to the NCMEC or your relevant regional authority.

We have integrated in-app reporting specifically for users to flag suspected CSAE or CSAM; users are required to use this feature or contact us at support@joinflokk.com. We will fully cooperate with law enforcement authorities and comply with all applicable child safety laws.

Severability

If any provision of these Terms is found invalid or unenforceable in whole or in part, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions remain in full force and effect.

Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy and any other legal notices published by Flokk, constitute the entire agreement between you and us concerning the Services.
  • Assignment: We may assign or transfer our rights and obligations under these Terms to a third party, provided this does not materially reduce your rights. You may not assign your rights without our consent.
  • Notice: We may contact you via email or in-app notifications; you agree to receive communications in electronic form.
